Rule 22 Journal Entries and Findings of Fact and Conclusions of Law

Unless the Court otherwise directs, counsel for the party in whose favor an order, judgment, or decree has been granted in a civil or domestic case, shall prepare a journal entry within 5 days thereafter, and shall submit it to opposing counsel who shall approve or reject it within three days after its receipt.

If all counsel agree to the proposed entry each shall sign, or authorize the attorney preparing the same to sign their name on the entry. The journal entry shall then be presented to the court for approval.

If opposing counsel objects to the proposed entry, the fact of the objection shall be noted on the signature line for that attorney on the entry. When a proposed entry is rejected, counsel may file written objections with the Court. Such objections shall be filed no later than 3 days after receipt of the proposed entry by opposing counsel.

If opposing counsel fails to sign and return, or to object to the proposed entry, then counsel preparing the same shall note that fact on the proposed entry and present the same to the Court with a Certificate of Service containing counsel's statement indicating whether there is opposing counsel, whether he has been informed of the filing and whether there is objection to the entry.

The Court shall approve a journal entry deemed by it to be proper, sign the same and cause it to be filed with the Clerk of Court. If a journal entry is not timely presented to the court by counsel then it may be prepared and journalized sua sponte by the Court.

When a request is duly made for findings of fact and conclusions of law, the Court may direct the party making the request to prepare within five days proposed findings of fact and conclusions of law and submit them to opposing counsel. Within 10 days after receipt by opposing counsel, the proposed findings shall be submitted to the judge with objections and counter-proposals, if any, in writing; however only those findings of fact and conclusions of law made by the Court shall form a part of the record.
