CLERK OF COURTS

FAQ'S

OFTEN ASKED QUESTIONS IN THE TITLE OFFICE

Q. Is it okay to change any information on a certificate of title if what is printed on the title is not correct?
A. Never make any alterations or erasures on a certificate of title. If this is done, the title becomes null and void and a replacement title will have to be obtained at the individual's cost.

Q. Does the Notary Public have to be there when signing on the back side of a title?
A. Do not fill in any part of the assignment or application on the reverse side of the title, unless it is done in the presence of a Notary Public or other duly authorized person with power to administer oaths. All signatures must be notarized.

Q. If I think I have a car sold is it okay to complete the back side of the title before actually getting the money?
A. Do not execute the assignment on the reverse side of the certificate of title until a bonafide sale has been made. Make sure the assignment is complete, including selling price, buyer's name as he wants it, address and the correct mileage shown on the odometer. This information must be NOTARIZED at the time of the assignment.

Q. Can someone else go to the title office and sign for me?
A. No person can sign for you without a NOTARIZED power of attorney. This power of attorney is attached to our files and becomes a part thereof. You may obtain this form from this office or you can use one of your own if it is properly executed.

Q. How important is it to give the right mileage?
A. Federal and State law require that you state the mileage with the transfer of ownership. Read the odometer section carefully before completing it.

Q. If there is more than one owner on the title can just one of the owners sign the title when transferring the car?
A. All signatures are required to encumber or transfer the vehicle if all are living.
